NAVIGATION PROCEDURE
At "ACTIVITY EDGE (e-service)" and at www.activityedge.com we are interested in offering you a pleasant browsing experience.
The grouping of the displayed activities is based on the natural element with which the eligible leisure activity offered is most closely associated (land activities – sea activities – air activities), while there are special categories of winter activities and motorized activities.
You have the possibility to search based on your own criteria, depending on the type of activity you are interested in, the place where the activities take place, or the dates you wish.
In the description of each activity there is specific information about the place and the way the activity is carried out, the program of activities as defined by the Organizer, the duration of the activity, the degree of difficulty of the activity and the safety requirements, the necessary and the equipment provided, as well as the participation price per person.
The fees for the activities are determined by the Organizers. “ACTIVITY EDGE (e-service)” will not impose any additional charges on you, nor will we ask you to pay anything more than the stated amount per person for your participation in the eligible activity.
Important Notice:
CAUTION! The degree of difficulty described in each activity is not indicative! Some of the activities displayed on the website are activities of increased risk and are directed exclusively to Users (Participants) who have the necessary experience, skill and ability to carry them out.
Before booking an activity, and in any case before carrying out an activity, you must be satisfied that you meet the necessary conditions to participate in the eligible activity (good health and fitness, level of experience and practice, any certificate and/or license etc.).
Both "ACTIVITY EDGE (e-service)" and the Organizers (Partners) are NOT in a position to know and establish whether the User (Participant) is healthy or suffering from health problems, has satisfactory endurance and physical condition, the experience or the level to perform an Activity.
If the Organizer considers that you do not meet the necessary conditions to participate in the eligible activity, it has the right to refuse your access to it, possibly without refund. Find out about its policy from the specific information of the activity or, in case of doubt, you can submit a relevant question in advance.
If, nevertheless, you insist on participating in the activity in question, despite the Organizer's warnings, reservations and/or objections to the contrary, it is expressly and irrevocably clarified that "ACTIVITY EDGE (e-service)", the Operators, the natural persons who employed in it, and the Organizers (Partners) participating in its network, DO NOT BEAR ANY RESPONSIBILITY for possible physical injuries, or even possible death of a Participant, during the performance of an activity, and for reasons related to the Participant's inability to respond on the difficulty level of the activity.
In particular, if the Participant's inability to meet the difficulty level of an Activity causes a risk to the life or physical integrity of third parties, including the Organizer, and/or security personnel, the Participant is expressly informed, understands and accepts that face all legal consequences.
IN EACH CASE, PARTICIPANTS PARTICIPATE AND PARTICIPATE IN AN ACTIVITY AT THEIR OWN RISK, TAKING INTO ACCOUNT THEIR HEALTH, PHYSICAL CONDITION, LEVEL OF DIFFICULTY, THEIR REQUIRED DEGREE OF ERIAS, ANY LICENSE OR CERTIFICATE OF PARTICIPATION REQUIRED, OF THE LIMITS OF ENDURANCE AND OF THE GENERAL RISKS THAT EXIST AND EFFECT IN AN INCREASED RISK ACTIVITY.
The Participants declare responsibly, that they assume sole responsibility for any physical injury, and accept the possibility of death, which may be caused by their inability to respond to the degree of difficulty and the requirements of the chosen activity and do not maintain any demand or claim against " ACTIVITY EDGE (e-service)” and the services provided by it, through the website www.activityedge.com and the Electronic Platform, in relation to the execution of the activity, and waive in advance any such.
Users/Participants, who make a reservation for a third party under their responsibility and supervision, have the same responsibility. In particular, parents and guardians have sole responsibility for the health, physical integrity and life of their minor children, and must not put them at risk. In this case, the Organizer's possible refusal to allow the participation of the minor is fully justified, the parent exercising parental custody may face the consequences of the Law for exposing a minor to risk.
Participants are required to be adequately insured for pharmaceutical and hospital care while performing sports activities. It is clarified that the activities offered on the platform, unless otherwise specified, do not include insurance.
BOOKING PROCEDURE - PAYMENTS - DOCUMENTS:
To book an activity, you must be at least eighteen (18) years of age, and have the legal capacity to enter into a binding contract.
If you find an activity interesting and wish to make a reservation, you should select the relevant icon on your screen with the word "Booking". You will be asked to select a date, time and number of people. The platform automatically lists the price per person, as well as the total cost of the selected activity, including fees and taxes. If you wish to proceed and register your relevant choice, you should press the icon with the word “Register”.
Please do not submit booking requests for activities that take place the day after the date of the order. There is a possibility that it may not be accepted by the Organizer.
Immediately after Registering your choice, the platform will automatically take you to the payment environment. You can pay for your reservation either by Credit or Debit Card. Expenses or payment commissions imposed by the Bank shall be borne by the User. “ACTIVITY EDGE (e-service)” will not charge you any additional fees or charges.
"ACTIVITY EDGE (e-service)" collects the amount of payment in the name and on behalf of the Organizer, who has authorized it as a payee, and assigns it to him based on the terms of the Cooperation Agreement drawn up between him and him.
It is not possible to pay a percentage of the price or pay an advance to register the reservation. The Participant is obliged to pay the entire amount of the reservation for the activity he has chosen. “ACTIVITY EDGE (e-service”) will not ask you to provide financial guarantees in order to register or accept your reservation.
Upon completion of the payment, a proof of payment and proof of the pre-booking (voucher) will be sent to the e-mail you have registered. "ACTIVITY EDGE (e-service)" will contact the Organizer directly to confirm the reservation, and we will send you the final confirmation of your reservation. The above documents are not tax documents - legal proof of tax use (Invoice/Proof of Services), however please keep them in your inbox or save them on some permanent medium, in order to show them, if and when you are asked.
If, for any reason, the specific activity is not available on the specific day and time, we will inform you of the other available days and times, or of a similar activity being conducted in the same area during the same period. If you do not wish to change the activity, there is the possibility of canceling the order and returning your money. For more information on the Cancellation Policy, select the corresponding tab, or click here.
In a reasonable period of time before the predetermined date of the activity, and no longer than ten (10) days, "ACTIVITY EDGE (e-service)" will send you an electronic message reminding you of your reservation, with the Organizer's contact information, and the exact location of the performance of the activity, in which case you will be able to contact the Organizer directly to carry out the activity.
The final tax document (Invoice/Proof of Services) is issued by the Organizer and delivered directly to the User/Participant, without in principle the mediation or involvement of "ACTIVITY EDGE (e-service)".
Changes to the Pricing Policy
The prices for the activities are determined exclusively by the Organizer. Especially in the organized trip (package) that may be planned and offered by "ACTIVITY EDGE (e-service)", we do not deviate from the prices set by the Organizer. Any changes to the Promoter's pricing policy will only apply to contracts not drawn up by the date of revision.
After the conclusion of the organized travel contract, an increase in prices can be valid and applied, provided that the Organizer has reserved for himself the relevant right, and only if the relevant increases concern the cost of transporting passengers (e.g. increases in the prices of fuel or other sources of energy), the level of taxes or fees relating to the provision of tourist or travel services (e.g. tourist taxes, airport taxes, embarkation or disembarkation charges at ports or airports) or exchange rates relating to packet. The Organizer is obliged to notify you of the relevant changes no later than twenty (20) days before the start of the package, in a fixed medium, with a detailed calculation of the relative increase in the price of the package and justifying this increase, while setting a deadline for acceptance of the charge in question, providing information on the consequences of the missed deadline and possibly offering an alternative package. In any case, said increase cannot exceed eight percent (8%) of the total price of the package. Otherwise, you have the right to terminate the contract without paying a termination fee.
Since the Organizer reserves the right to the above increases in the price of the package, the Participant is entitled to request a reduction in the price of the package, corresponding to the reduction of the above-mentioned costs that may occur, as long as said reduction takes place after the conclusion of the contract and before the start of the package. In this case, the Organizer has the right to withhold the actual administrative costs of the refund owed to the traveler, upon presentation of the relevant proofs, if requested by the Traveler.
If you terminate the contract due to the above limit of the permitted increase in the price of the package, you have the possibility to subsequently accept another package that may be offered by the same Organizer, at the price for which you have already paid, if possible of equivalent or superior quality. If the alternative package offered is of lower quality or cost, you are entitled to a price reduction, as above.
PROCEDURE FOR ASSIGNING THE CONTRACT TO A THIRD PARTY:
You have the possibility, if you wish, to assign the contract to a third party, who meets the requirements of the Law regarding the possibility to franchise and participate in the activity, and if you inform the organizer in time, and no later than seven (7) days before the date start of the package, for which you have reserved, and on a permanent medium, communicating to him the details of the transferee (the person who will eventually join).
The Assignor (Initial Participant) shall be jointly and severally liable with the Transferee (Final Participant) for the payment of any additional fees, charges or other costs that may arise from the assignment. The actual cost of the assignment is determined each time by the Organizer, and the related costs are aimed at rehabilitating the Organizer from any burden due to the assignment of the contract. In any case, and if you so wish, whether you are the Transferee or the Assignor, you can request that the Organizer provide you with the relevant evidence for the said additional fees, charges or other costs that may arise from the assignment.
In case of doubt, and to avoid unpleasant situations, please contact the Organizer in advance if you intend to assign your contract.
EXECUTION OF THE ACTIVITY
The Organizer is responsible for the execution of the activities and in general the travel services included in the package travel contract, regardless of whether these services are to be performed by the organizer or by other travel service providers.
If the traveler, during the performance of a travel service included in the organized travel contract, finds any lack of compliance, he has the right to inform the organizer without culpable delay, taking into account the specific circumstances, and request the remediation of the relevant lack of compliance. The organizer is obliged to remedy the specific lack of compliance, unless this is impossible, or involves disproportionate costs, taking into account the extent of the non-compliance and the value of the travel services affected.
Without prejudice to these exceptions, in the event that the Organizer does not remedy the lack of compliance within a reasonable period set by the Traveler, or, if said remedy is necessary to take place immediately, or the Organizer expressly refuses to remedy the lack of compliance , the Traveler may do so himself, immediately without the need to set a deadline, and demand compensation for the necessary expenses.
In the event of the Organizer's refusal or inability to remedy the lack of compliance, the traveler is additionally entitled to: a) a price reduction for any period of lack of compliance, unless the organizer proves the traveler's responsibility for the lack of compliance, and/or b) compensation by the organizer for any damage suffered due to any lack of compliance. Compensation is paid without culpable delay. The right to compensation is excluded if the organizer proves that the lack of compliance is attributable to the traveler, to a third party unrelated to the provision of the travel services included in the organized travel contract and is unforeseeable or unavoidable, or is due to unavoidable and extraordinary circumstances.
Note:
To the extent that international conventions binding the Union limit the extent of compensation or the conditions under which compensation is paid by a provider performing a travel service included in a package, the same restrictions apply to the organizer. To the extent that international conventions not binding the Union limit the compensation payable by a service provider, the compensation payable by the organizer shall be limited accordingly. In other cases, the package travel contract may limit the compensation to be paid by the organizer, provided that such limitation does not apply to bodily injury or damage caused intentionally or negligently and does not amount to less than three times the total price of the package.
Any right to compensation or reduction of the price hereunder shall not affect the rights of travelers under the Regulations: (EC) No. 261/2004 (EE L 46/17.2.2004), (EC) No. 1371/2007 (EE L 315 /3.12.2007), (EC) No. 392/2009 (EE L 131/28.5.2009), Regulation (EU) No. 1177/2010 (EE L 334/17.12.2010) and Regulation (EU) No. 181/2011 (EE L 55/28.2.2011), as well as based on international conventions. Travelers are entitled to make claims hereunder and under said Regulations and international conventions. The compensation or price reduction provided for herein and the compensation or price reduction provided for in said Regulations and international agreements shall be offset in order to avoid undue compensation.
Claims pursuant to this article are time-barred after the expiration of two years from the return date provided for in the contract.
Especially:
- When a large percentage of the travel services cannot be provided as agreed in the package travel contract, the Organizer offers, without additional charge to the traveler, suitable alternative arrangements, where possible of equivalent or higher quality than those specified in the contract, for the continuation of the package , including the case in which the return of the traveler to the place of departure does not take place as agreed. When the proposed alternative arrangements result in a package of inferior quality to that specified in the package travel contract, then the organizer offers the traveler an appropriate price reduction. The traveler may reject the proposed alternative arrangements, only if they are not comparable to what was agreed in the package travel contract or if the proposed price reduction is insufficient.
- In the event that alternative arrangements are not possible or if the traveler rejects the proposed alternative arrangements, the traveler is entitled, as the case may be, to a price reduction and/or compensation, without terminating the organized travel contract.
- Possibility of cancellation without a cancellation fee is provided when the lack of compliance significantly affects the execution of the package and the organizer does not remedy it within a reasonable period specified by the traveler. In this case, a claim for a price reduction and/or compensation is possible, depending on the circumstances.
- If the package includes passenger transportation, the organizer, in addition to the price reduction and/or compensation, also arranges for the repatriation of the traveler by similar means of transport without culpable delay and at no additional cost to the traveler. If it is impossible to ensure the return of the traveler as agreed in the package travel contract due to unavoidable and extraordinary circumstances, the organizer shall bear the cost of the necessary provision of accommodation, where possible of an equivalent category, for a period not exceeding three nights per traveler. If the Union passenger rights legislation applicable to the particular means of transport for the return of the traveler provides for a greater number of overnight stays, this shall apply. The limitation of costs to the minimum necessary that applies to the average Traveler does not apply to people with reduced mobility, as defined in case a' of article 2 of Regulation (EC) No. 1107/2006 (EE L 204/26.7.2006) , and any person accompanying them, pregnant women and unaccompanied minors, as well as for persons in need of special medical assistance, as long as the organizer has been notified of their special needs at least forty-eight (48) hours before the start of the package. The organizer also cannot invoke unavoidable and extraordinary circumstances to limit its liability for providing accommodation, if the relevant transport service provider cannot rely on these circumstances, based on the applicable legislation of the Union.
