“ACTIVITY EDGE (e-service)” and www.activityedge.com act as intermediaries between the Organizer (Partner) and the Participants. Therefore, when you book an activity through www.activityedge.com, you are booking directly with the Partner.
At “ACTIVITY EDGE (e-service)” and www.activityedge.com, we have tried to create a general framework for Policy regarding possible cancellations, amendments, transfers, and rescheduling of activities, considering all potential circumstances with respect to the Traveler and the business and operations of our Partners.
ATTENTION: To avoid last-minute cancellations, which can represent significant losses for our Partners and disappoint the traveling public, each Partner can choose the cancellation policy they deem appropriate for their activities based on certain predefined options. Therefore, please read carefully the description of the activities where specific details regarding the Partner's Cancellation Policy may be included.
If the Partner has not defined a specific Cancellation Policy, the Policy of “ACTIVITY EDGE (e-service)” and www.activityedge.com applies.
You can cancel your activity at any time BEFORE the start of the package. Specifically:
Exceptionally, cancellation of the activity or package or associated travel arrangement before the start of the package is accepted WITHOUT CHARGE and without any cancellation fee if unavoidable or extraordinary circumstances occur at or near the destination that significantly affect the execution of the activity or package or significantly affect the travelers' access to the destination. In this case, you have the right to request a full refund of the money paid, excluding any claim for additional compensation.
What are considered unavoidable or extraordinary circumstances All situations or circumstances that are beyond the Participant's sphere of influence and which objectively, with reference to the average prudent person, could not have been foreseen at the time of contracting and could not have been avoided even with utmost diligence and prudence, or if the diligence and foresight of a diligent person are exercised.
Declaration of emergencies and epidemics: If a state of emergency, epidemic, pandemic, or public health emergency is declared at a local or state level. Does not apply to diseases that are endemic or usually associated with a region.
Government travel restrictions: Travel restrictions imposed by a government agency that prevent or prohibit travel to, from, or return from the location where the activity takes place (e.g., a sailing or flight ban if the activity takes place near a port or airport and access is not possible by other means). Does not apply to non-binding travel advisories and related government guidelines.
Military actions and other hostilities: Acts of war, hostilities, invasions, civil war, terrorism, explosions, bombings, revolutions, uprisings, civil unrest, and internal conflicts.
Natural disasters: Natural disasters, extreme and unusual weather phenomena of great intensity or scale. Does not apply to weather or natural conditions that are common enough to be predictable at the locations where activities are held.
What is not covered: All other cases. This Policy only allows refunds for cancellations due to the events described above. All other events are excluded. Examples of cases for which cancellations are not permitted under this Policy include unexpected illness, disease or injury, government obligations such as jury duty, court appearances, or military duties, travel advisories or other government guidelines (that do not constitute a travel ban), cancellation or rescheduling of an event for which the booking was made, and transportation problems not related to an event covered by this Policy, such as road closures, and cancellations of flights, trains, buses, and ferries. If you cancel a booking in these cases, the amount refunded will be determined by the Cancellation Policy of the respective Organizer or, alternatively, as defined by law and this Cancellation Policy.
In the event that you do not show up for the activity at the scheduled day and time at the activity location, you lose the right to request rescheduling, cancellation, or a refund. The Partner will inform “ACTIVITY EDGE (e-service)” about the Participant's non-appearance via email within 24 hours from the scheduled date and time of the activity. In this case, the activity is considered to have taken place.
The Organizer has the right to confirm the booking up to forty-eight (48) hours before the start of the activity. If this period passes without confirmation from the Organizer, the booking is considered canceled by the Organizer. In this case, the Traveler receives a full refund of the money paid.
Organizers can cancel an activity due to force majeure, unavoidable or extraordinary circumstances, or if conditions make it impossible or unsafe to conduct the activity (e.g., due to weather conditions). In this case, they will notify “ACTIVITY EDGE (e-service)” and www.activityedge.com as soon as possible so that the Participant is informed in a timely manner and the activity is rescheduled if possible without any additional cost to the Traveler. If the activity cannot be conducted on another day or time, the customer receives a refund of the money paid.
In the case of an organized trip or connected travel arrangement, the Organizer has the right to terminate the contract with a refund to the Traveler in the following cases: a) If the number of registered persons for the package is less than the minimum number specified in the contract, and the Organizer notifies the Traveler of the termination of the contract within the period specified in the contract: (i) twenty (20) days before the start of the package for trips lasting more than six days, (ii) seven (7) days before the start of the package for trips lasting between two and six days, (iii) forty-eight (48) hours before the start of the package for trips lasting less than two days. b) If the Organizer is unable to perform the contract due to unavoidable or extraordinary circumstances and notifies the Traveler of the termination of the contract without undue delay before the start of the package.
To avoid unnecessary cancellations, especially from Organizers, “ACTIVITY EDGE (e-service)” and www.activityedge.com impose a cancellation fee on the Partner as specified in the Collaboration Agreement.
“ACTIVITY EDGE (e-service)” and www.activityedge.com reserve the right to lock the account of a specific Organizer through their system, remove the activity from display, and/or terminate the collaboration agreement after five (5) consecutive unjustified cancellations by the Organizer or failure to accept Participant bookings.
